
The U.S. District Court for the District of Nebraska entered judgment totaling $3,423,389.84 against Joan Kicken and AME P.C., doing business as Campbell Drug, after the defendants failed to defend against the government's False Claims Act complaint.
Federal prosecutors alleged in the complaint, filed in October 2025, that the defendants submitted improper claims to federal health care programs. The allegations included billing Medicaid for prescription drugs that were never issued, billing for medications that were never dispensed, and seeking reimbursement for name-brand drugs while dispensing lower-cost generic versions in order to obtain higher payments.
The government said the conduct, if proven, violated rules governing reimbursement under Medicare and Medicaid and resulted in the improper payment of federal funds.
"Medicaid and Medicare exist to ensure that every American has access to the care they need. Fraud against these programs is an attack on that promise," said U.S. Attorney Lesley A. Woods.
The Department of Health and Human Services Office of Inspector General also supported the enforcement action, emphasizing its role in investigating health care fraud.
"Those who defraud Medicaid and Medicare will be held accountable," said Linda T. Hanley, special agent in charge of HHS-OIG. "HHS-OIG will not hesitate to investigate, expose, and pursue individuals who knowingly steal from federal health care programs."
Nebraska Attorney General Mike Hilgers said Medicaid funds are intended to support vulnerable residents and that fraudulent activity undermines those goals. He credited cooperation between the Medicaid Fraud Unit, the U.S. Attorney's Office and HHS-OIG in pursuing the case.
The judgment was entered on May 29, 2026, following the defendants' failure to respond to the government's allegations.
