In a lawsuit filed last week, the Blue Cross Blue Shield Association alleges trademark infringement by Ohio-based Medical Lien Pros.
The complaint, filed in Ohio Southern District Court on Nov. 5 by Vorys, Sater, Seymour, and Pease, said that Community Insurance Co., a plaintiff in the case, unlawfully registered and used the “Anthem Blue Cross and Blue Shield” name in May 2025 — causing confusion in legal proceedings, with at least 10 lawsuits being incorrectly served.
“Anthem has spent countless millions of dollars in marketing and using the Anthem [trade]marks widely, which has resulted in widespread recognition of the Anthem [trade]marks by consumers across the United States, including in Ohio,” according to the complaint. “Anthem did not give defendant consent or authority to use the Anthem [trade]marks in any capacity.”
The Blue Cross Blue Shield Association is requesting that Medical Lien Pros stop using the name, account for profits accrued under the name, and pay BCBS to cover damages.
