Texas Supreme Court’s Barbara Tech Ruling Leads Appellate Court to Reverse Trial Court’s TPPCA Decision
An appellate court in Texas, relying on the Texas Supreme Court’s decision in Barbara Techs. Corp. v. State Farm Lloyds, has ruled that an insurer’s payment of an appraisal award did not bar a claim for statutory interest and attorneys’ fees by insureds under the Texas Prompt Payment of Claims Act.
