Do your clients know if their health plans include gag clauses? Most if not all of the marketplace has no information available to them regarding gag clauses or how to submit attestations. These gag clause attestations require the plan sponsor to attest that they do not have clauses in their contracts that prohibit access by the plan participants to quality or cost of care information. In these cases, the plan sponsor is a fiduciary because they direct the spending of plan participants' assets, and under the 2021 Consolidated Appropriations Act (CAA), these fiduciaries have new requirements.
