New federal protections for pregnant and nursing employees take effect in 2023

Together, the PWFA (effective June 29, 2023) and the PUMP Act (Effective Jan. 1, 2023) are rare bipartisan laws aimed at enhancing protections for pregnant and nursing mothers in the workplace.

On December 29, 2022, President Biden signed into law two laws protecting pregnant and nursing mothers. The two laws were included as part of the bipartisan funding package passed by Congress in late December. The two laws are the Pregnant Workers Fairness Act (PWFA), and the Providing Urgent Maternal Protections (PUMP) for Nursing Mothers Act.
