The biggest debate around remedies for surprise bills has centered on how to determine payment for out-of-network charges.

But the court raised the possibility that much of the ACA could survive the death of the individual mandate provision.

"The individual mandate is unconstitutional because it can no longer be read as a tax," the split panel wrote.

If out-of-network billing were eliminated, patient spending on health care would drop 3.4 percent, or by roughly $40 billion annually.
